MY ACE COURIER EXPRESS SUBSCRIPTION PLAN TERMS AND CONDITIONS & CUSTOMER CONSENT FORM

This document (“Agreement”) constitutes a legally binding agreement between the Subscriber ("Customer", "You", "Your") and MY ACE COURIER SERVICES PRIVATE LIMITED (“Company”, "We", "Us", "Our"), having its registered office at B2/21, Gandhi Path, Vaishali Nagar, Jaipur Rajasthan - 302021.

By purchasing, accessing, or using the My Ace Courier Express Subscription Plan ("Subscription Plan"), You unconditionally accept and agree to comply with these Terms and Conditions in their entirety.

1. Eligibility

● Only individuals who are Indian citizens aged 18 years and above are eligible to purchase this Subscription Plan.
● Each Subscription is intended for personal or business use of courier and logistics services and is non-transferable and non-refundable under any circumstances.
● There is no cap on the number of Subscription Plans a Customer may purchase; multiple subscriptions increase chances in lucky draws.
● No upgrade or consolidation from smaller plans to larger plans is permitted once purchased.
● Corporate or institutional customers must ensure the subscription is used in compliance with applicable laws and company policies.

2. Subscription Plan Structure and Validity

● Plan Fee: ₹599/- (Rupees Five Hundred Ninety-Nine only), inclusive of GST.
● Subscription Activation Date: Date of successful purchase confirmation.
● Service Credit: ₹599 equivalent in MyAce Miles (1 Mile = ₹1), credited to Customer’s loyalty pouch.
● Miles Usage: Lifetime validity for redeeming against courier and logistics services exclusively provided by the Company within India.
● Lucky Draw Validity Period: 1st September 2025 to 31st August 2026. No Lucky Draw entries after 31st August 2026.
● First Lucky draw for September 2025 Month will be drawn at the subsequent date of October 2025 Month or first week of October 2025 - Month.

3. Benefits and Coupon Entitlements

● One (1) Yearly Jackpot Coupon eligible for ₹1 Crore Cash Lucky Draw.

● One (1) Monthly Coupons eligible for Scooty Lucky Draw each month during the Lucky Draw Validity Period.
● Coupons are strictly non-transferable, non-exchangeable , and non-redeemable cash or other goods or services.
● Coupons hold no intrinsic monetary value outside of this Subscription Plan.

4. Lucky Draw Process

● All Lucky Draws will be conducted through computerized randomization systems proper supervision to ensure fairness and impartiality.
● Draw results will be published on the Company’s official communication channels and winners will be contacted using registered contact details.
● If a winner does not claim the prize, provide complete verification, or respond within 15 days of notification, the Company reserves the right to disqualify the winner and select an alternate winner without further obligation.

5. Prize Delivery, Taxes, and Documentation

● Winners must submit full KYC documentation including but not limited to Aadhar Card, PAN Card, and address proof for prize claim and verification.
● Prizes will be delivered to the registered address provided at the time of subscription purchase.
● All statutory taxes, levies, duties, and incidental charges related to the prizes (including income tax under Section 194B of the Income Tax Act, 1961) shall be solely borne by the winner.
● The Company may display branding, marketing materials, or promotional content on Scooty prizes at its sole discretion.

6. Abuse, Fraud, and Misconduct Prevention

● Any misuse, fraudulent activity, manipulation of the draw system, or violation of the terms will result in immediate cancellation of the subscription without refund or notice.
● The Company reserves the sole right to audit and verify subscription activities and Customer information at any time.
● The Company reserves the right to initiate civil and/or criminal proceedings against any participant involved in fraudulent acts.

7. Data Privacy and Communication

● By subscribing, you authorize the Company to collect, store, and use your personal information (name, contact details, ID proof, etc.) for the purposes of subscription management, prize delivery, and promotional activities.
● You consent to receive transactional SMS, WhatsApp messages, calls, or emails from the Company.
● Your personal data will not be shared with third parties without your consent, except as required by law.

8. Modification, Suspension, and Termination

● The Company reserves the right to modify, suspend, or terminate the Subscription Plan, benefits, prizes, or any related terms at its absolute discretion, by providing a reasonable notice through public communication.
● In the event of plan termination, accrued benefits and earned Miles shall remain valid unless specified otherwise.
● Subscription once purchased cannot be cancelled, revoked, or refunded under any circumstances.

9. Limitation of Liability

● The Company, its affiliates, employees, and directors shall not be liable for any direct, indirect, incidental, special, or consequential losses or damages arising out of or in connection with this Subscription Plan.
● The Company's aggregate liability, whether in contract, tort (including negligence) or otherwise, shall not exceed the Subscription Plan fee paid by the Customer.

10. Indemnification

● You agree to indemnify, defend, and hold harmless the Company and its affiliates from any claims, liabilities, damages, costs, and expenses (including legal fees) arising out of your misuse of the Subscription Plan, breach of these Terms, or violation of any applicable laws.

11. Force Majeure

● The Company shall not be liable for any failure to perform its obligations where such failure results from any cause beyond the Company’s reasonable control, including but not limited to natural disasters, war, strikes, governmental action, labor disputes, pandemic, or interruption of utilities or communications.

12. Severability

● If any provision of these Terms is held to be illegal, invalid, or unenforceable under applicable law, the remaining provisions shall remain valid and enforceable.

13. Governing Law and Jurisdiction

● This Agreement shall be governed by and construed in accordance with the laws of India.
● All disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts at Jaipur, Rajasthan, India.

By purchasing, accessing, or using the My Ace Courier Elite Subscription Plan ("Subscription Plan"), You unconditionally accept and agree to comply with these Terms and Conditions in their entirety.

1. Eligibility

● Only individuals who are Indian citizens aged 18 years and above are eligible to purchase this Subscription Plan.
● Each Subscription is intended for personal or business use of courier and logistics services and is non-transferable and non-refundable under any circumstances.
● There is no cap on the number of Subscription Plans a Customer may purchase; multiple subscriptions increase chances in lucky draws.
● No upgrade or consolidation from smaller plans to larger plans is permitted once purchased.
● Corporate or institutional customers must ensure the subscription is used in compliance with applicable laws and company policies.

2. Subscription Plan Structure and Validity

● Plan Fee: ₹999/- (Rupees Nine Hundred Ninety-Nine only), inclusive of GST.

● Subscription Activation Date: Date of successful purchase confirmation.
● Miles Usage: Lifetime validity for redeeming against courier and logistics services exclusively provided by the Company within India.
● Lucky Draw Validity Period: 1st September 2025 to 31st August 2026. No Lucky Draw entries after 31st August 2026.

4. Subscription and Activation

● Subscription entitles the applicant to be considered for franchising based on merit, infrastructure readiness, and alignment with Company standards.
● Subscription alone does not guarantee approval of franchise rights till you do not met with our eligilbity creiteria.

Applications are subject to strict internal verification, including:

● Background checks.

● Area feasibility analysis.

● The Company retains sole and absolute discretion to accept or reject any applicant, without assigning any reason, and without liability.

7. Training, Certification & Selection

● Mandatory training of 3-7 days or 15 to 20 Hrs online training sessions organized by the My Ace Courier & Services as a precondition for becoming a Elite Courier Franchisee
● Only upon successful completion of training will the Elite franchise license be activated.
● Certificate of Training Completion may be issued to successful candidates but shall not be construed as a right to permanent franchise without My Ace Courier & Services approval.
● Company holds the right to select the franchisees based on their performance after completing 3-6 months of their probation period

8. Termination and Disqualification

● Franchise rights may be revoked without refund for:

a. Failure to complete training.

b. Business inactivity or underperformance.

c. Customer complaints or negative service audits

d. Breach of brand standards.

e. Any act detrimental to Company interests.

9. Limitation of Liability

● Under no circumstances shall the Company, its affiliates, directors, or officers be liable for any loss or damages (direct, indirect, incidental, or consequential) arising out of:
a. Participation in the Subscription Plan,

b. Non-selection,

c. Non-winning of any promotional prize,

d. Franchise operational risks.
● Subscriber agrees to fully indemnify and hold harmless the Company against all third-party claims arising out of subscriber's conduct.
